Terms and Conditions
These terms and conditions govern the sale of products offered by Super Scorcher LLC. in the Super Scorcher Store to the purchaser of the product (the "Buyer"). By checking the accept box before adding the product to the cart, the Buyer acknowledges and accepts the terms and conditions outlined below.
Orders: All orders are subject to acceptance by Super Scorcher. The cancellation of orders is subject to our cancellation policy.
Price: The product's price is as specified on Super Scorcher’s website at the time of purchase, plus applicable shipping costs, customs duties, and all taxes. Buyer agrees to indemnify and hold Super Scorcher harmless for any liability related to taxes or duties. Shipping costs and taxes will be shown as separate line items on the purchase receipt.
Delivery and Title: Title and risk of loss transfer to the Buyer upon delivery to the carrier. Super Scorcher's delivery dates are estimates, and Super Scorcher is not liable for delays beyond its control.
Returns, Refunds, and Exchanges: Refer to our Shipping and Return Policy.
Limitation of Liabilities: Buyer's recovery from Super Scorcher for any claims related to the product's purchase or use shall not exceed the product's price. Super Scorcher is not liable for defects caused by specified factors, and no warranties apply, express or implied.
Trade Control Laws: Buyer certifies compliance with import and export control restrictions.
Use of Product: The product is not authorized for certain applications. Buyer agrees that Super Scorcher is not liable for any claims arising from unauthorized use and agrees to indemnify Super Scorcher.
Force Majeure: Super Scorcher is not liable for order fulfillment failure or delivery delays due to events beyond its reasonable control.
Technical Assistance or Advice: Technical assistance or advice provided is complimentary and at the Buyer's risk. Super Scorcher is not liable for the content or use of such assistance or advice.

Arbitration and Class Action Waiver: Any controversy or claim shall be settled through arbitration administered by the American Arbitration Association. The Buyer agrees to litigate only in an individual capacity.
Privacy Policy: The handling of Personal Information is as per our Privacy Policy.
RISK: The buyer understands that the operation of a pyrotechnic device, such as the ones manufactured and or sold from Super Scorcher, carries an inherent risk to both the operator and the surrounding environment. The buyer agrees that all operators of pyrotechnic devices will exercise caution when in use, agrees that products carried by Super Scorcher will only be used in a recreational manner, and agrees to not hold Super Scorcher liable for any and all physical damage or harm caused through the negligent use of Super Scorcher products.
Customer Acknowledgment and Certification: By purchasing any item from Super Scorcher, the customer certifies, acknowledges, and agrees to the following:
The customer is solely responsible for ensuring that the purchase, possession, ownership, and use of any item purchased from Super Scorcher with all applicable federal, state, and local laws, regulations, and ordinances in the customer’s jurisdiction.
The customer has independently verified that its purchase and intended use of any item is legal in the customer’s state and local jurisdiction.
The customer agrees to release, indemnify, and hold harmless Super Scorcher and its affiliates from any liability, claims, or legal consequences arising from the customer’s purchase, ownership, possession, or use of any item purchased from Super Scorcher.
Failure to comply with applicable laws may result in severe legal penalties. If you are unsure about the legal status of an item in your area, consult a qualified attorney or local law enforcement before making a purchase.
